What you need to know to acquire a property in Morocco :
1/ LEGAL STATUS OF THE PROPERTY :

a) Properties with title deeds are registered at the Land Registrar.`
The organization of registration in Morocco is under the responsibility of l'Agence Nationale de la Conservation Foncière ,du Cadastre et de la Cartographie (ANCFCC) ,i.e. the national agency for land registrar and mapping.
Each property is individualized and must be reported on the Registrar. The registration resulting thereof leads to the creation of a title deed with a reference number and a detailed description of the property , its location and the identity of the owner.
The title deed is final and unquestionable.

Properties under the "melkia" system are all properties that have not yet been registered at the Land Registrar.
For the purchase of a "melkia" property,it is advisable to verify the number of rightful claimants, to make sure all heirs are present at the time of the sale and to check the location and the characteristics of the property.
The transfer of a "melkia" property can be made through (dahir dated February 7th,1944) or through a deed executed by a notary (article 531 of dahir dated may 4th,1925)
A "melkia" property may be turned into a registered property as long as the process is followed with the Land Registrar.
However,this process is time consuming and generates additional costs.
